Basic eFiling Questions
How does eFiling work?
Electronic filing (or eFiling) allows Filers and Courts to process documents and fees online. eFileTexas manages the flow of information among Filers and Clerks.
Filer Submits Documents
After selecting a certified electronic filing service provider (EFSP), filers log on to their provider's website to file case documents online to any participating court in Texas. Once a login is created, filers can use that login at an EFSP website.
EFSP Delivers Documents to the Court
EFSPs validate that the required data elements are completed at the time of submission as well as calculate filing fees and court costs to electronically deliver the submitted documents to participating courts.
Clerks Accept or Return Submissions
Court Clerks receive the eFiled documents and associated fees for review. The clerks will either accept the filing(s) and will provide an electronic timestamped copy of the documents upon acceptance. If something is wrong, the clerk may return your submission for correction. Any associated fees will be refunded.
What is an EFSP?
eFiling in Texas is done through Electronic Filing Service Providers (EFSPs), which are applications run by independent companies that collect filings from Filers and transmit them to eFileTexas. Some EFSPs offer value added services beyond the state provided EFSP.
Is eFiling secure?
Yes. The eFile system adheres to state and federal security regulations and meets Payment Card Industry Security Standards (PCI DSS) to protect filer and transaction information. Filings are encrypted both in transit and at rest.
What is eService?
eService is a feature provided by eFileTexas where documents are electronically served to other parties in a case via e-mail. Using this option, you can track when each party received and opened the filing.
Note: Although there is no cost to use the State EFSP, transaction and services fees may apply depending on the EFSP used to perform eService.
How do I serve other individuals with my eFiled documents?
Filers must serve all filings on other parties to the case as required by applicable court rules. Service options include mail service, hand delivery, email, or eFileTexas’s eService functionality.
Can I use eService without filing a document with the court?
Yes, eFileTexas may be used to electronically serve documents between parties without filing the document through the courts.
Understanding Fees
Is there a fee to use eFileTexas?
While the state-provided EFSP does not charge usage fees, all electronic submissions with associated court costs are subject to a convenience fee. Other commercial EFSPs may charge additional use fees depending on the additional services selected.
